Motions Filed Criminal Cases

A motion is an application to the court made by the prosecutor or defense attorney, requesting that the court make a decision on a certain issue prior to, during and after the trial begins. The motion can affect the trial, courtroom, defendants, evidence, or testimony. Only judges decide the outcome of motions.

Bills of particular

These are motions that force the commonwealth to  particularize exactly what it is that a defendant is being charged with, so as to give the defendant a better understanding of what he or she has to defend against.

Witness Subpoenas

These are motions that call upon the court to summon witnesses on your behalf, even if these witnesses are not directly involved in the case.

Analysis of evidence

These are motions that called upon the court to order that evidence in the case is analyze, and a report is issued to all parties involved, including the court . You don’t have to just accept the other side, saying they have evidence against you.

To Quash Indictments

These motions call upon the court to dismiss indictments that are illegal and insufficient to bring a person properly before the court or criminal charges.

Racial makeup of jury and jury pool

These motions call upon the court to dismiss a jury based on illegal, make up of the jury pool, from which the jury that sits on your keys is drawn from, and it moves the court to dismiss the jury that actually sits to hear your case based on the fact that that jury pool or jury or illegally composed. Generally, this happens when the jury is racially embellished and does not represent a fair cross-section of the population, specifically excluding members of a defendants, or a plaintiffs race.

Representing Yourself

These motions, all filed on behalf of persons who wish to represent themselves in court without the assistance of an attorney.

Speedy Trial Violation

These motions a filed when a defendant has not been properly, taking a trial within the timeframe specified by the general assembly of Virginia, thus depriving the court of jurisdiction to hear and try a case.

Discovery

Discovery motions found in order to obtain evidence that is in the position of the opposing party in both civil and criminal cases. This evidence allows you to better defend and prosecute your case, and can often lead to other evidence in your favor, one filed property asking for the right things.

Expert witnesses for defense

Often times criminal defendants are faced with a mountain of evidence put on by the state, and the evidence often comes from their expert witnesses. This motion ensures that the defendant has he his, or her own expert to challenge the states expert.

Evidence Preservation

These motions are vital to preserve evidence discovered, and or utilized in the case, so as to ensure that the evidence is kept on file in case it is needed in the future for things, such as retesting, or being tested for the first time.

To set aside verdict

Are filed in order to have a court overturn an adverse verdict that went against you.

For appointment or removal of & attorney

These motions are filed asking the court to appoint a lawyer when you need one to represent you, or, on the other hand, when you want to remove an attorney who you think is not working in your best interest and with whom you are incapable of preparing and executing a defense on your behalf.

Notice of Appeal 

This notice is filed to the court that you are currently in front of notifying them that you are going to appeal an adverse ruling to the next highest court.

Mental Health Evaluation

This motion is filed in order to have the court appoint a mental health expert to evaluate you one to determine your sanity at the time and offense occurred; it can also be filed to determine your sanity to stand trial and assist in your own defense.
